Welcome to kcmusic.in, a platform dedicated to helping independent songwriters and musicians share, promote, and monetize their original music. By accessing or using our website, services, or tools, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully.
1. Eligibility
KCMUSIC is intended for individuals who are at least 18 years of age. If you are under 18, you may only use the platform under the supervision of a parent or legal guardian who agrees to be bound by these terms. By using this platform, you warrant that you have the legal capacity to enter into a binding agreement and that all registration information you submit is truthful and accurate. You are responsible for ensuring that your use of KCMUSIC complies with all applicable local, national, and international laws and regulations.
2. User Accounts
To access certain features of the platform, you may be required to register and create a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. KCMUSIC is not liable for any unauthorized use of your account. You agree to notify us immediately of any breach of security or unauthorized use. Creating an account with false information or impersonating another individual is strictly prohibited. We reserve the right to suspend or terminate your account at our discretion, especially in cases of misuse or violation of these terms.
3. User Content & Ownership
KCMUSIC allows users to upload and publish original music content, including audio files, lyrics, artwork, and promotional assets. You retain full ownership of your intellectual property. However, by uploading your content, you grant KCMUSIC a non-exclusive, royalty-free, worldwide license to host, store, display, promote, distribute, and sell your content through our platform. You affirm that you have obtained all necessary rights, permissions, and licenses to use and distribute the content and that it does not infringe upon the intellectual property rights of any third party. KCMUSIC does not claim ownership of any user content and does not sell or license music without the artist’s consent. Any legal liability arising from the upload, sale, or distribution of copyrighted or infringing content will rest solely with the artist. KCMUSIC disclaims all responsibility and liability in such matters. KCMUSIC may, at its discretion, feature your content in promotional campaigns, newsletters, or editorial placements.
4. Music Sales and Earnings
Artists using KCMUSIC can set the pricing for their music and make it available for purchase through our platform. KCMUSIC may deduct a nominal platform fee or processing fee as applicable. Payments are managed through secure third-party payment gateways, and artists must ensure that their payment details are up-to-date. Payouts will be made on a periodic basis (e.g., monthly or bi-monthly), subject to minimum threshold amounts and compliance checks. KCMUSIC is not responsible for delays caused by banking institutions or third-party payment processors.
5. Prohibited Content
You are strictly prohibited from uploading or sharing any content that:

Violates intellectual property rights or copyright laws

Contains hate speech, harassment, threats, or promotes violence

Includes sexually explicit, obscene, or defamatory material

Promotes illegal activities or violates any applicable law

Contains viruses or malicious software KCMUSIC reserves the right to remove any content that violates these guidelines without prior notice. Repeat violations may result in permanent account suspension.
6. Platform Rights
KCMUSIC retains the right to make changes to the platform, including modifying features, updating design or functionality, and altering content presentation without prior notice. We may, at our sole discretion, feature certain songs or artists for promotional purposes. While we strive to ensure uninterrupted access, we do not guarantee continuous availability of the platform due to maintenance, updates, or technical issues. We also reserve the right to suspend or terminate accounts that pose a risk to the security or integrity of the platform.
7. Limitation of Liability
KCMUSIC is not liable for any direct, indirect, incidental, or consequential damages arising out of your use or inability to use the platform. This includes, but is not limited to, loss of earnings, exposure, content misuse by third parties, or technical disruptions. You use the platform at your own risk. We do not guarantee specific results in terms of sales, audience growth, or engagement. All content is provided "as is," and we make no warranties regarding its accuracy or performance.
8. Third-Party Services
To provide various services, KCMUSIC integrates with third-party platforms, including payment gateways, analytics providers, and social media tools. We are not responsible for the actions, terms, or privacy policies of these third-party services. Users are advised to review their respective terms before engaging with such platforms. Any issues arising from the use of third-party services must be resolved directly with those providers.
9. Termination
You may choose to delete your account at any time through the user dashboard. KCMUSIC reserves the right to suspend or terminate any user account for breaches of these Terms & Conditions, abuse of the platform, or any behavior that undermines the safety or integrity of the community. Upon termination, any pending payouts (if applicable) will be processed in accordance with our payout policy.
10. Governing Law
These Terms & Conditions are governed by the laws of India. Any disputes arising from the use of KCMUSIC shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra. Users agree to comply with all local, national, and international regulations applicable to their use of the platform.
